By accessing, registering, adding funds, using the API, joining the affiliate program, or placing an order on https://www.smm.gg ("SMM.GG", "we", "us", "our"), you confirm that you have read, understood, and agreed to these Terms of Service, our Privacy Policy, our Refund Policy, and any service-specific rules shown on the platform.
If you do not agree with these Terms, do not use SMM.GG.
1. Eligibility & Acceptance
- You must be at least the age of majority in your jurisdiction, or have permission from a parent or legal guardian, to use SMM.GG.
- These Terms apply to all users, including customers, resellers, affiliates, API users, and visitors.
- By creating an account, adding balance, or placing an order, you accept these Terms in full.
- We may update these Terms when needed. Continued use of SMM.GG after an update means you accept the updated Terms.
2. Service Description
- SMM.GG provides digital social media marketing services through automated delivery systems and fulfillment infrastructure.
- Service names, descriptions, quantities, refill terms, speed estimates, limits, and restrictions are part of the service terms and must be reviewed before ordering.
- All orders are processed electronically after submission. Some services may start instantly, which can limit cancellation or modification options.
- We may update, replace, pause, or remove services at any time to maintain platform stability or service quality.
3. Orders & User Responsibilities
- You are responsible for submitting accurate links, usernames, quantities, service selections, and order details.
- Orders submitted with incorrect, invalid, private, removed, restricted, changed, or inaccessible links may fail and are not eligible for refund unless required by law or approved by SMM.GG support.
- Once an order is submitted, it cannot be canceled, modified, or reversed unless cancellation is available for that service or approved by support.
- Placing multiple orders on the same link/profile before earlier orders complete may cause delays, counting issues, wasted balance, or failed delivery. SMM.GG is not responsible for those results.
- You must not use SMM.GG in a way that violates the rules of any social platform, payment processor, law, or third-party rights.
4. Delivery, Drops & No Outcome Guarantees
SMM.GG does not guarantee:
- Permanent results
- Zero drops
- Exact delivery speed
- Social platform stability
- Account safety, reach, ranking, revenue, engagement quality, or business outcome
Additional notes:
- Delivery times are estimates only.
- Social media platforms frequently update their systems, which may cause drops, delays, interruptions, restrictions, or service instability.
- Where a service is completed, SMM.GG's responsibility is limited to the ordered service quantity as recorded by our system, subject to the service description and these Terms.
- Service-specific refill or replacement terms apply only when stated in the service description.
5. Balance, Fees & Refund Policy
- Balance added to SMM.GG is a prepaid digital balance used only for SMM.GG services.
- To the fullest extent permitted by law, payments are final and are not withdrawn back to the original payment method after balance is credited.
- Refunds or credits, when approved, are normally issued to SMM.GG account balance only.
- Account-balance credit may be issued if:
- An order has not started and cancellation is available or approved
- An order is partially completed because of a service failure
- SMM.GG determines after review that balance credit is appropriate
- No balance credit or refund is owed for drops, delays, removed/changed/private links, wrong service selection, multiple orders on the same link, social-platform actions, or account bans/restrictions/suspensions unless required by law or expressly approved by SMM.GG.
- Any fees, totals, and payment amounts shown at checkout should be reviewed before payment. By completing payment, you approve the displayed total.
- Nothing in this section limits any non-waivable consumer rights that apply to you.
6. Prohibited Usage
You agree not to use SMM.GG for:
- Illegal content, illegal activity, or rights-infringing activity
- Hateful, violent, abusive, exploitative, or harassing material
- Fraud, stolen payment methods, unauthorized transactions, or chargeback abuse
- Spam, platform abuse, scraping, bot attacks, vulnerability testing, or system manipulation
- Orders that violate applicable laws, payment-network rules, or social-platform rules
Violations may result in: order cancellation, support review, account restriction, account termination, balance forfeiture where permitted by law, and legal action if necessary.
7. Account Safety & Security
- You are responsible for maintaining the security of your account, password, email, API key, and devices.
- Sharing accounts, API keys, or access with unauthorized parties is prohibited.
- You are responsible for all orders, API requests, balance usage, and support actions made from your account unless SMM.GG determines there was unauthorized access not caused by your negligence.
- Report suspected unauthorized access to support immediately.
8. Social Platform Risk & Liability
SMM.GG is not responsible for actions taken by social media platforms, including account bans or restrictions, post deletion, content removal, shadow bans, reduced reach, profile limitations, username changes, deleted links, or analytics changes.
To the fullest extent permitted by law, SMM.GG is not liable for indirect, incidental, special, consequential, punitive, lost-profit, lost-revenue, lost-client, or reputational damages. Where liability cannot be excluded, SMM.GG's total liability is limited to the amount paid for the affected service.
9. Privacy & Data Protection
- SMM.GG collects and uses account, order, payment, API, security, analytics, and support information to operate the platform, process orders, apply payments, provide support, prevent fraud, and improve the service.
- Order and account data may be processed by technical systems, payment processors, hosting services, fraud-prevention tools, analytics tools, and delivery infrastructure only as needed to operate SMM.GG.
- We do not sell user personal information.
- Data may be disclosed when required by law, legal process, payment-network rules, fraud investigations, or to protect SMM.GG, users, or the public.
- SMM.GG aims to handle personal information in line with applicable Canadian privacy requirements, including PIPEDA where applicable.
- For access, correction, deletion, or privacy questions, contact support through the panel or email support@smm.gg.
10. Communications
- SMM.GG may send service messages about account activity, orders, payments, support, security, policy updates, or system notices.
- Marketing messages are sent only where consent exists or where permitted by applicable law.
- Commercial electronic messages will include required identification and unsubscribe options where applicable.
- You may opt out of marketing messages, but service, security, payment, and transactional notices may still be sent when necessary.
11. Intellectual Property
- All SMM.GG branding, design, software, copy, systems, workflows, logos, graphics, and infrastructure are protected by intellectual property and unfair competition laws.
- You may not copy, resell, redistribute, scrape, reverse-engineer, mirror, frame, or modify SMM.GG systems or content without written permission.
12. Service Continuity
SMM.GG may modify, pause, restrict, replace, or discontinue services, features, payment methods, APIs, promotions, affiliate tools, or the platform itself at any time. We may suspend or terminate accounts that violate these Terms, create risk, or abuse the platform. Where permitted by law, termination may result in loss of access to account data and unused balance.
13. Fraud, Disputes & Chargebacks
- If you believe a payment, order, or balance adjustment is incorrect, contact SMM.GG support first so we can review it.
- Unauthorized-payment claims are reviewed with available account, payment, device, and order records.
- Fraud, payment abuse, false claims, chargeback abuse, stolen payment methods, or attempts to receive services without payment may result in account closure, balance forfeiture where permitted by law, evidence submission to payment processors, and legal action.
- Filing a chargeback or external dispute for a completed or credited payment without first contacting support may be treated as abuse where permitted by law.
14. API Usage
- API access is provided for automation and integration purposes only.
- API users are responsible for all orders, requests, balance usage, and account activity made through their API credentials.
- Abuse, excessive requests, scraping, reverse engineering, credential sharing, unauthorized access, or attempts to bypass limits may result in suspension or termination.
- SMM.GG does not guarantee API uptime, availability, accuracy, compatibility, or uninterrupted access.
15. Affiliate, Reseller & Promotional Programs
- Affiliate, reseller, referral, coupon, and promotional programs may be changed, paused, denied, reversed, or discontinued at any time.
- Self-referrals, fake accounts, fraud, spam, misleading claims, and abuse of promotional systems are prohibited.
- Commissions, bonuses, or promotional balances may be withheld or removed if abuse is detected.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of Canada, without regard to conflict-of-law principles. Subject to any non-waivable rights or required consumer forum rules that apply to you, disputes relating to SMM.GG shall be handled by the courts of Canada, and users consent to the jurisdiction of those courts.
17. Consumer Protection
- SMM.GG operates as a digital service platform and does not guarantee outcomes, performance, social-platform behavior, or account safety.
- Users acknowledge that social media marketing services involve risks, including drops, delays, failed delivery, changing platform rules, or account restrictions imposed by social platforms.
- Nothing in these Terms excludes, restricts, or modifies any legal right that cannot be excluded, restricted, or modified under applicable law.
- Where permitted by law, SMM.GG's liability is limited strictly to the amount paid for the affected service.
18. Final Agreement
These Terms, the Privacy Policy, the Refund Policy, and service-specific descriptions form the entire agreement between you and SMM.GG regarding use of the platform. If any part of these Terms is found unenforceable, the remaining sections remain in effect. Failure to enforce any section does not waive our right to enforce it later.
